Declaration of the Trans Rights Conference

We, the participants of the European Trans Rights Conference, yearn for a Europe free from all discrimination1, where all people are valued equally irrespective of their gender identity and gender expression. We envision a Europe where people of all gender identities and gender expressions are fully respected and can live freely without any violations to their human rights and institutions’ interferences in their private lives, in accordance with the Yogyakarta Principles2. We want a Europe where health insurance funded adequate hormonal and surgical medical assistance is available in a non-pathologizing manner to all those trans people3 who seek it, and where no trans person is required to undergo any compulsory medical treatment (such as sterilization or gender reassignment surgeries) or a mental disorder diagnosis in order to change legal gender and/or name.....

TGEU has issued a statement in support of the international campaign by the Trans Depathologization Network for the removal of the Gender Identity Disorder category from the international diagnosis manuals (the DSM and the ICD).

The five demands of the STP-2012 campaign are as follows:

1.The retirement of GID from the international diagnosis manuals (their next versions DSM-V and ICD-11)
2.The retirement of sex mention in the official documents
3.The abolition of the binary normalization treatments to intersex people
4.Free access to hormonal treatments and surgery (without the psychiatric monitoring)
5.The fight against transphobia: working for education, social and labour insertion for trans people
In addition, TGEU is calling for these additional actions:

•The creation of an alternative non-pathologizing category in the ICD 11, recognizing that our gender identities are not mental health disorders while still enabling hormonal and surgical medical assistance to be provided for those trans-people who seek such assistance.
•The funding of hormonal and surgical medical assistance for trans people by national health insurance.
•The creation of processes for changing legal name and gender without compulsory treatment or any form of diagnosis.
TGEU also adds:

In 2008 the Steering Committee of TGEU already published a declaration, stating “that the stigmatization, which in part is grounded in the mistaken assumption that gender variance is prima facie a medical disorder, is discriminatory” and demanding that “[a]ny revision of the DSM and the ICD must be carried out with full compliance to the Yogyakarta Principles on the Application of International Human Rights Law in relation to Sexual Orientation and Gender Identity” (see Yogyakarta Principle 18 “Protection from Medical Abuse”).

The Steering Committee of TGEU very much welcome and support the position taken by the Council of Europe’s Commissioner for Human Rights, Thomas Hammarberg, in his Issue Paper “Human Rights and Gender Identity”:

“The first aspect in discussing health care for transgender persons is the existence of international and national medical classifications defining transsexuality as a mental disorder… Such classifications may become an obstacle to the full enjoyment of human rights by transgender people, especially when they are applied in a way to restrict the legal capacity or choice for medical treatment… Alternative classifications should be explored in close consultation with transgender persons and their organisations. From a human rights and health care perspective no mental disorder needs to be diagnosed in order to give access to treatment for a condition in need of medical care.”
Campaign Background:

The campaign “Stop Trans Pathologization: Goal 2012″ of the Trans Depathologization Network aims at initiating and monitoring actions directed against the “Gender Identity Disorder” category in international classifications of diseases, especially focusing.

The revision of the DSM IV will finish in 2012 with the publication of the new DSM V. The Network has intensified its actions, and decided to have coordinated demonstrations and other actions demanding the depathologization of trans identities in as many cities as possible around the globe always in October until the year 2012.

A joint action among French and Spanish trans groups in 2007 was the starting point of the Trans Depathologization Network. Since then they have broadened their scope and have continued organizing demonstrations against trans pathologization in every October. In 2008, already 11 European cities participated in joint actions. This year the set date for demonstrations in cities worldwide is October 17th. To date, more than 80 trans organizations and allies from more than 40 cities in Africa, the Americas, Asia and Europe have confirmed their participation or expressed their support and many more are expected to join in over the next few weeks.

Dia de Acção Internacional 17 de Outubro de 2009 - Campanha Stop Patologização Trans 2012

No próximo sábado, 17 de Outubro de 2009, vão realizar-se manifestações e outras acções em 38 cidades da Europa, América Latina, América do Norte e Ásia em apoio à campanha Stop Patologização Trans 2012, convocadas por mais de 180 organizações e redes internacionais que aderiram à Rede Internacional pela Despatologização Trans.
O Dia de Acção Internacional será igualmente assinalado em Lisboa, com o Lançamento Público da Campanha portuguesa no Largo de Camões, às 15h. A acção pública é convocada pelas organizações que subscrevem o presente comunicado.
O alvo principal desta campanha é influenciar a revisão, prevista até 2012, dos catálogos internacionais de diagnósticos (DSM-IV, da OMS, e CIE-10, da Associação Americana de Psiquiatria). que, tal como faziam há mais de 30 anos com a homossexualidade, ainda hoje mantêm a classificação da transexualidade como uma doença do foro mental, fomentando a discriminação transfóbica e a exclusão social das pessoas trans em todo o mundo, e atentando contra os Direitos Humanos de integridade corporal e livre expressão das identidades de género, direitos reconhecidos em declarações internacionais recentes como os Princípios de Yogyakarta (2007) o as recomendações do Comissário de Direitos Humanos do Conselho da Europa, Thomas Hammarberg (2009).

Não se podem chorar lágrimas de crocodilo pelo assassinato de pessoas trans, como há 3 anos, no Porto, foi o caso de Gisberta, uma mulher transexual que de alguma forma personificava todos os exemplos de vulnerabilidade social a que esta população está sujeita, e deixar tudo como está.
Num ano em que pela primeira vez, em Portugal, o partido do governo acaba de ser re-eleito com uma menção à “identidade de género” no seu programa, esta é uma campanha sobre o conjunto dos direitos que faltam às pessoas transexuais, transgénero e intersexuais, e as medidas concretas que se exigem ao poder político:

- O repensar urgente do programa de “tratamento da transexualidade”: fim da OBRIGATORIEDADE de acompanhamento psicoterapêutico e avaliação psiquiátrica. A transexualidade NÃO é uma doença mental!
- Acesso à assistência médica e tratamento hormonal e cirúrgico pelos serviços públicos de saúde às pessoas trans que o procurem.
- Inclusão da “identidade de género” no artigo 13º da Constituição da República.
- Uma Lei da Identidade de Género e educação e protecção contra a Transfobia.
- Direito a alterar o nosso nome e sexo em todos os documentos oficiais sem ter que passar por nenhuma avaliação médica, nem psicológica, ou por tratamento obrigatório ou diagnóstico.
- Concessão imediata de asilo político às pessoas trans imigradas que chegam ao nosso país fugindo de situações de violência extrema.
- Direito à mudança de nome e sexo nos documentos de identificação sem tratamento obrigatório ou diagnóstico, ou qualquer avaliação médica ou judicial.
- Fim do parecer obrigatório da Ordem dos Médicos sobre os processos de transexuais.
- Fim das operações a recém-nascidxs intersexo.
- Fim da esterilização obrigatória de transexuais masculinos.
- Combate às dificuldades e discriminação no acesso ao mercado laboral pelas pessoas transexuais e transgéneros.
- Condições dignas de saúde e segurança para trabalhadorxs sexuais e o fim do assédio policial a que estão sujeitxs, bem como do tráfico sexual.
